Unscrupulous Military Officer Tried for Domestic Violence Against Wife and Daughter; Victim Demands Restitution

JAKARTA, BERITAPOLITIK.ONLINE – A heartbreaking event involving a wife and mother of two daughters, a female soldier who has served the Indonesian Army since 2006, has now reached the courtroom. RP, the victim’s initials, is not only a victim of domestic violence or KDRT (physical, psychological, and sexual), but she also witnessed the suffering of her two underage daughters, who were also abused by her husband, an unscrupulous TNI officer or Oknum Perwira TNI, Letda Cba. Yudhavan Timor Adyoko. The military trial held on October 10, 2024, has drawn attention from various parties, including Commissions I and III of the Indonesian House of Representatives (DPR RI), the Supreme Court, LPAI, the Ministry of Women Empowerment and Child Protection (PPPA), LPSK, the Indonesian Advocates Congress, and other organizations.

RP, was a soldier and graduate of the 13th NCO and the 29th Panorama Officers’ program in 2019 sacrificed much for her career and family. She even gave up her rank and position when offered a chance to continue her military education in 2020 to preserve her family. However, despite her sacrifices, she received devastating news of her husband’s alleged affair with another woman at his post in Manado, Mabekangdam XIII/Merdeka. Her attempts to save the marriage, despite enduring physical, psychological, and sexual abuse, ultimately led to legal proceedings.

The defendant/husband, who is currently on trial at the Manado Military Court, had previously been sentenced to fired and imprisonment for 10 months by the Surabaya Military High Court. However, the defendant filed a cassation legal remedy at the Supreme Court of the Republic of Indonesia to the Supreme Court and this case is still in process.

On October 10, 2024, the trial held at the Jakarta Military Court II-08 or Pengadilan Militer II-08 Jakarta focused on the defendant’s alleged abuse of their two underage daughters. This crime has provoked strong reactions from various groups calling for justice for the victim and her children, who have been deeply traumatized by these acts.

RP’s legal team and family questioned the military court’s actions to ensure legal certainty and protection for the children, who suffered abuse at the hands of their biological father. They also demanded restitution for the children, as outlined in the relevant legal frameworks, including Government Regulations No. 35 of 2020 and No. 43 of 2017, as well as the Supreme Court Regulation (PERMA) No. 1 of 2022 on compensation for victims of criminal acts.

RP and her legal team hope for a fair legal process without interference, as this case has been dragging on since 2021 without a clear resolution. RP, now struggling to support her two daughters with her parents’ help, has lost almost all her possessions, which were forcibly taken. Her signature was also forged by her husband to apply for a loan from BRI Manado, allegedly under the influence of his mistress, who had threatened the victim and her children.

This case has gained the attention of the Chief Justice of the Indonesian Supreme Court, who has requested that the defendant’s appeal be expedited. Additionally, the leadership of Commission III of the DPR RI has sent official letters to relevant authorities, urging legal protection for the victim and her children.

The trial, led by the Jakarta Military Advocate II-07 Jakarta or Oditur Militer II-07 Jakarta, is scheduled to take place at 10:00 a.m. WIB with the agenda of hearing witness testimony. Ironically, even though the trial was delayed and only opened at 14:15 WB, the Military Advocate was still unable to bring the defendant to court.

It is hoped that the truth can be revealed and justice given to the victim and her two daughters, as well as firm action taken against those who protect the defendant’s criminal actions.

The victim also expressed her gratitude to Allah SWT for the strength given to face all these trials steadfastly. She hopes that with the help of various parties, including 2024 President-elect Prabowo Subianto, she and her children can get the justice they have been fighting for.

The victim hopes that her two daughters will no longer be constrained in the field of education, “They have been traumatized to drop out of school, and now want to be able to go to school as the right of the nation’s children. However, the Mojokerto District Education Office makes it difficult and does not help child victims who are currently under the protection of Mojokerto City Child Protection,” said RP.

This trial is a test of Indonesia’s legal system in upholding justice for victims of domestic violence and other crimes that damage the lives and futures of children who should be protected.

The next hearing, scheduled for October 14, 2024, will continue to focus on witness testimony. The victim and her legal team hope that the truth will be fully revealed and justice served for her and her daughters. (sdk)
